For a Foreign Investor in Nevada, a Limited Liability Company (LLC) is a recommended entity for both investing in and holding long term investments in real estate.  The unique structure of an LLC offers individual members extensive protection from legal action by a tenant or sub-trade, but also from legal action unrelated to the LLC that an individual member may face.  If a judgment is obtained against an individual member (through a separate business failure, divorce, etc.), to the extent that the operating agreement so states, the LLC cannot be compelled to satisfy the judgment against that member.

There also may be distinct tax advantages for a Foreign Investor to use an LLC – at present, the the tax rate compared to personal rates would ostensibly drop from 30% to 15%, and taxes levied in the United States should likely be credited against related tax liability in the investor’s domicile country.  A Foreign Investors requires an ITIN number, which is more easily obtained in conjunction with the filing of the first tax return for the LLC – an EIN number is obtained right away in order to open a bank account and arrange utilities.

The LLC should be proactively structured in advance of a purchase, but is quite easy to do – subsequently, the title goes right into the name of the LLC.  Also, properties purchased prior can then be moved into the LLC.
